These Terms of Service ("Terms") are the agreement between you and Danish Shah, trading as Cusentra Mail ("we", "us") for Cusentra Mail (the "Service"). By creating an account or using the Service you agree to them. If you do not agree, please do not use the Service.
In short.
1.1 Us. The Service is provided by Danish Shah, trading as Cusentra Mail. You can reach us at danish@cusentra.com.
1.2 What the agreement is made of. These Terms, our Refund Policy (which forms part of them) and, if you use the Service for an organisation, our Data Processing Agreement. Our Privacy Policy and Cookie Policy explain how we handle personal data; they are information we owe you, not terms you are asked to accept.
1.3 Who sells you a paid plan. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. You buy a subscription from Paddle.com Market Ltd ("Paddle") under Paddle's buyer terms, and we provide the Service to you under these Terms. Paddle handles payment, receipts, sales tax and refunds; we never see or store your card details.
1.4 Consumers and organisations. If you use the Service for a business, profession or organisation, you accept these Terms for it and confirm you may bind it; "you" then includes it. Some protections in these Terms, and in the law, apply only to consumers - people using the Service for their own personal purposes. The country terms in section 22 apply where you live.
2.1 What it does. Cusentra Mail is an email client and assistant for a Gmail mailbox you already have. It connects with a Google app password you create, keeps a working copy of your mail so the inbox is fast, sorts mail into categories and flags what needs attention, and offers AI features: summaries, drafted replies in your writing style, a chat about your mailbox, the Launch Agent and suggestions for your rules. Your Gmail mailbox remains the system of record: the copy we keep is described in the Privacy Policy, and it never replaces your mailbox.
2.2 Sorting uses rules, not AI. Categories and detections run on rules you can see and change. That matching never calls an AI model and never sends your mail to anyone.
2.3 You stay in control of what is sent. The Service never sends an email unless you press Send - for a reply, a forward, a new message or a batch of drafts from the review queue. Automations you set up can prepare drafts and summaries for you to review, and an arrival rule you create can post the envelope of a new email (sender, subject, date and a link, never the body) to your own Slack, Microsoft Teams or Discord, or save it as a note in your own Notion, Google Docs or OneNote. Nothing is sent anywhere else on its own.
2.4 Plans. There is a Free plan and paid plans (Starter at $15/month, Pro at $29/month), each with weekly allowances described on our pricing page. When an allowance runs out that feature pauses until it resets; you are never charged more.
Your use of Gmail stays subject to Google's terms. When you connect another service - Notion, Slack, Microsoft Teams, Discord, Google Drive, Docs or Calendar, OneNote - its own terms and privacy policy apply to it, we send it only what a feature you set up sends, and you can disconnect it at any time under Connections. We are not responsible for those services, and when one is unavailable a feature that depends on it may not work. How we use data we receive from Google is set out in the Privacy Policy, including Google's Limited Use requirements.
6.1 Renewal. A paid plan is a monthly subscription. It renews automatically every month, on the date you first paid, and is charged at the price shown at checkout (with any tax Paddle adds) until you cancel. Once a year we email you a reminder that it renews and how to cancel.
6.2 Cancelling and withdrawing. You can cancel at any time with the Cancel contracts here button on the Plans page or on our Withdraw or cancel page, in Paddle's portal at paddle.net, or by emailing us. Cancelling stops the next renewal and you keep the plan to the end of the period you paid for. Every paid plan comes with a 14-day money-back guarantee, counted from your first payment: within those days, Withdraw from contract here ends the plan and refunds every payment in full. The full rules, including when else we refund, are in the Refund Policy.
6.3 Changing plans. You can move between paid plans at any time. An upgrade is charged pro rata for the rest of the current period and a downgrade is credited pro rata against the next bill; the exact amount is shown before you confirm.
6.4 Price changes need your agreement. If we want to raise the price of your plan, we email you 30 days before the new price would first apply and ask you to accept it. If you do not, your plan carries on unchanged to the end of the period you have paid for and then ends, and you are never charged a new price you did not agree to.
6.5 Failed payments. If a renewal cannot be collected, Paddle retries it. Your plan lasts to the end of the period you last paid for; after that the account carries on on the Free plan.
You must not use the Service, or let anyone else use it, to:
If you break these rules we may limit a feature, suspend your account or end it, as section 15 explains. We act in proportion to what happened and tell you why, unless the law or someone's safety prevents it.
Your mail, attachments, notes, rules and everything else you bring to the Service stay yours. You give us a worldwide, non-exclusive, royalty-free permission to store, copy, process, transmit and display that content only to provide, secure and support the Service for you, as the Privacy Policy describes, for as long as you use the Service and the retention periods it states. We do not use it to advertise, we do not sell it, and we do not use it to train AI models. If you send us feedback or a suggestion, we may use it to improve the Service without owing you anything for it; that never covers your content.
We and our licensors own the Service, its software, design and brand. While you use the Service we give you a personal, non-exclusive, non-transferable permission to use it as these Terms allow. Open-source parts are licensed under their own terms (for example the PDF preview library, Apache 2.0, and the landing page's font, SIL Open Font License).
Our Privacy Policy explains what we collect and why, where it is stored (the European Union (Frankfurt, Germany)), who helps us process it, and your rights. If you use the Service for an organisation, our Data Processing Agreement applies automatically and governs how we process personal data in your mail on your behalf.
The Service depends on others: Google for Gmail and sign-in to your connected Google services, Paddle for payments, our hosting and database providers, and the AI providers named in the Privacy Policy. We choose them carefully and are responsible to you for the Service, but we cannot control their availability, and a change they make may force a change in ours (section 14).
We work to keep the Service available and fast, but we do not promise it will be uninterrupted or error-free, and we may pause it briefly for maintenance. If a fault on our side stops your paid features for a long time, the Refund Policy gives money back. Support is by email at danish@cusentra.com; we acknowledge within 48 hours.
We may change the Service for valid reasons: to keep it secure, to comply with the law or a regulator, because a provider we rely on (Google, Paddle, an AI provider) changes what it offers, to improve features or performance, or to stop a feature few people use. If a change materially reduces what a paid plan you hold gives you, we tell you by email 30 days before it takes effect (unless security or the law requires faster action), and you may cancel without charge within 30 days of that notice and get a refund for the unused part of the period you paid for. A change that only adds or improves needs no notice.
15.1 You can stop at any time: cancel your plan (section 6.2), or delete your account under Connections, which deletes your data as the Privacy Policy describes and cancels a paid subscription at once.
15.2 We may suspend or end your access if you seriously or repeatedly break these Terms (especially section 7), if a payment you owe is not made, if the law or a court requires it, or if your account puts the Service or other people at risk. Where we can, we warn you first and give you time to put things right. We may also stop offering the Service altogether, for any reason, with at least 30 days' notice. A Free account nobody has used for two years is deleted, after an email warning at least 30 days ahead, as the Privacy Policy explains.
15.3 Afterwards. If we end your account for any reason other than your breach of these Terms, we refund the unused part of the period you paid for and give you at least 30 days to download your data first, unless the law forbids it. Sections that by their nature should last - such as 9, 16, 17 and 19 - survive the end of the agreement.
Apart from what these Terms say and what the law guarantees you, the Service is provided "as is" and "as available". To the extent the law allows, we do not give other warranties, such as that the Service is fit for a particular purpose or that AI output is accurate. Nothing in this section limits a right a consumer has by law that cannot be limited - those rights always apply.
17.1 What we never limit. Nothing in these Terms limits or excludes our liability for death or personal injury caused by negligence, for fraud, for harm caused intentionally or by gross negligence, under product liability law, for our duty to give the refunds in the Refund Policy, or for anything else the law does not allow to be limited.
17.2 For consumers. We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care and skill. Loss is foreseeable if it was an obvious consequence, or we both knew it might happen when you started using the Service. We are not responsible for losses you suffer in a business you run. The country terms in section 22 add to this where your law says so.
17.3 For organisations. We are not liable for indirect or consequential loss, or for loss of profit, revenue, business or goodwill.
17.4 The cap. Subject to 17.1, our total liability to you for all claims relating to the Service is limited to the greater of the amount you paid for the Service in the 12 months before the event giving rise to the claim, and US$100.
17.5 Your mailbox. Your mail lives in your Gmail mailbox, which we do not replace. Deleting a message in the Service deletes it in Gmail, as with any mail client, so take care with delete-forever actions.
18.1 Talk to us first. If you have a complaint, please write to us (section 23). We acknowledge within 48 hours and try to resolve it within 30 days. Neither of us goes to court during those days unless something urgent or a time limit makes it necessary.
18.2 Law and courts. These Terms are governed by the laws of India, and the courts of India have jurisdiction over any dispute about them or the Service.
18.3 If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in the courts there; we can only bring a claim against you in the courts of the country where you live. We do not use arbitration, and nothing in these Terms stops you joining a claim with others where your law allows it.
You must not use the Service in breach of sanctions or export control laws, including those of the United Nations, the European Union, the United Kingdom, the United States and India, and you may not make it available to anyone those laws forbid.
We may change these Terms for valid reasons: a change in the law or a regulator's guidance, a change to the Service (section 14), a new feature, security, or to make them clearer. If a change is worse for you, we email you 30 days before it takes effect, explaining what changes. If you do not agree, you can stop using the Service and cancel before then, and we refund the unused part of the period you paid for. If you keep using the Service after the date, the new Terms apply - except a price rise, which needs your agreement (section 6.4). Changes that are not worse for you can apply at once. The date at the top always shows the current version.
If you live in one of these places, these terms also apply to you, and they prevail over anything above that says otherwise.
